Nova Market Terms of Use
General
- By using the “Nova Market” platform on the Tribe of Nova Community Association website (the “Association“, “Nova Market” and the “Website“, respectively), the user agrees to the terms of use set out below.
- If you do not agree to any term, you must immediately cease all use of the platform.
- These Terms of Use are in addition to the Website’s general terms of use and do not derogate from them.
- It is clarified that the mere appearance of a business on Nova Market does not constitute a recommendation, positive opinion or encouragement by the Association to purchase the product or service, and Nova Market should not be viewed as sponsorship by the Association of the business or as any business or other cooperation between them.
No Liability
- Use of Nova Market and of the information presented on it is the sole responsibility of the user.
- The information appearing on Nova Market is presented as-is. The Association bears no responsibility for the content of the information presented on the Website and/or for any errors and/or inaccuracies and/or omissions in the information, and is not responsible for the reliability or completeness of the information or its suitability for the user’s needs. The user shall have no claim, demand or cause of action against the Association regarding the information, content, publications or their suitability for the user’s needs.
- The Association shall not bear any responsibility for any direct or indirect damage, loss, expense or harm arising from any use or non-use of Nova Market or from information appearing on Nova Market.
- The Association is not a party to any engagement, agreement or transaction entered into between a business owner appearing on Nova Market and its customers. The Association will not be responsible under any circumstances for the quality of the service, quality of products, delivery times, or any damage, loss or distress caused as a result of use of the platform. Any dispute shall be resolved directly between the business owner or business and the user or customer, without involvement of the Association.
Use of Links to External Destination Pages
- The links are provided for the user’s convenience only.
- Unless otherwise stated on the external destination page, there is no legal or commercial relationship between the Association and the creator of that page, and the Association has no control over or rights in the material appearing on those pages.
- The Association is in no way responsible for the content found on an external destination page.
- Links to external destination pages should not be interpreted as approval, endorsement, recommendation or preference by the Association of those linked pages, including documents and any other material contained in them, the operators of the pages, or the information presented in them. The existence of a link to a particular external destination page does not indicate that the content of the linked external page is reliable, complete or up to date, and the Association shall bear no responsibility in this regard.
- The Association does not undertake that all links found on Nova Market will be functional or will lead the user to the correct external destination page or to any active website. The Association may remove links previously included in Nova Market, or refrain from adding new links, all at its sole discretion.
Changes and Malfunctions
- The Association makes efforts to ensure that Nova Market operates properly and continuously, but does not undertake that the platform will not be interrupted or that it will be provided without interruptions. The Association will not be responsible for disruptions, malfunctions or failures in hardware, software or communication lines, whether of the Association or any of its suppliers, and will not bear responsibility for any damage arising from temporary unavailability of the platform, technical changes made to it, or events as described in this section.
- The Association may from time to time change the structure of Nova Market, including its appearance, scope, content and any other aspect related to it, without any need to provide prior notice. These changes will be made, among other things, in light of the dynamic nature of the internet and the technological and other changes occurring in it. By their nature, changes of this type may involve malfunctions or initially cause inconvenience and the like.
- The user shall have no claim, demand or cause of action against the Association regarding changes made to Nova Market, or regarding malfunctions that occur in Nova Market or its availability.
Information Security
- The Association implements advanced security mechanisms and takes accepted precautions to secure the information on the Website. The user is aware that the Association dedicates resources and takes measures to prevent intrusion into the Website and to prevent possible harm to users’ privacy, but it cannot completely prevent disruptions on the Website. Intrusion into the computer systems of the Website or of the Association constitutes a criminal offense under the law.
- The user is aware that use of the internet is exposed to security risks, breaches and disclosure of information. The Association clarifies that in cases beyond its control and/or arising from force majeure, it does not undertake that the Website will operate regularly without any interruption and/or that the Website and/or the information and data collected and/or provided will be absolutely immune from unauthorized access and/or intrusion into the Association’s databases. The user is aware that the Association will not bear responsibility for any direct or indirect damage and/or loss of any kind caused as a result, including due to violation of privacy.
Termination of Use and Disputes
- The Association may, at its discretion, terminate the activity of any user of Nova Market services if the user does not comply with any term of these regulations, or violates any provision of law, including by blocking an IP address.
- Any dispute and/or claim and/or lawsuit relating to the use of Nova Market and/or Nova Market content and/or anything arising from and/or related to Nova Market shall be heard exclusively in the courts in Israel and under Israeli law only, without giving effect to any choice-of-law or choice-of-forum rules, and the jurisdiction of any foreign court, including any foreign tribunal or other adjudicative body, as well as the application of any foreign law, is hereby expressly excluded.
- If a competent court, including any court or other judicial tribunal, determines that any provision of these regulations is illegal and/or invalid, this shall not invalidate the remaining provisions of these regulations and/or the parts of that provision that were not canceled and/or narrowed by the legal authority.
Intellectual Property
- All copyrights and intellectual property rights in Nova Market, including the name, logo, graphic design, structure and content, belong exclusively to the Association or to third parties that permitted the Association to use them. The Association’s name or logo may not be copied, reproduced, distributed or used for any commercial or other purpose without the Association’s prior written approval.
- The Association’s name and/or logo may not be used for commercial and/or advertising purposes, nor may the Association be included as a user of any product or service, or in a manner implying commercial cooperation, or as a source of marketing or commercial information.
Privacy
- Use of Nova Market is subject to the Association’s privacy policy (the “Privacy Policy“).
- The mere use of Nova Market shall be deemed full consent to the Association’s Privacy Policy and an undertaking to act in accordance with its terms.
- When using Nova Market, information will be collected about the pages displayed to you, the content that interested you, how long you stayed on Nova Market and what actions you performed in it. The information does not personally identify you and therefore the information collected is of a general statistical nature only. The Association may retain this information and use it for its purposes subject to these Terms of Use and the provisions of any law. The Association may use information collected regarding your use of Nova Market for statistical production and analysis. The Association may provide such statistical data to third parties, provided the data does not relate to you personally or identify you personally.
- The Association does not control, supervise or bear responsibility in any way for the activity and privacy-protection policy of any third party, including any website, application or external source linked from Nova Market.
The Association reserves the right to change these Terms of Use at any time. Website users will receive an update upon any change or update to the Terms of Use at the Association’s discretion. Use of Nova Market after such change or update constitutes consent to use under the updated Terms of Use.
